SECURITY SYSTEMS INSTALLATION AND SERVICE CONDITIONS
1. It is the client’s sole responsibility: 1.1. To provide seven days’ notice of work required to be completed by Spy Vision 1.1.2. Provision of an accurate plan 1.1.3. Confirmation of security cameras plus DVR/NVR location. Further, the client acknowledges that any repositioning requirements after installation is complete will incur further charges. Any holes or cut-out left open due to this need to be repaired by the client. 1.1.4. 240V power points at the Recorder location. 1.1.5. Data point and active Internet is required for Remote View through smart device if necessary. 1.1.6. Connection of auxiliary equipment where applicable. 1.2. The client acknowledges that it bears sole responsibility for: 1.2.1. Any damage caused to wiring after installation. 1.2.2. Fitting of electrical door locking devices shall be the client’s responsibility unless detailed in scope of works 1.2.3. All trenches to be made available prior to commence of work, unless otherwise specified in writing by Spy Vision. 1.3. The client recognises and acknowledges that all security wiring is left visible by the plaster, carpenter, tiler, or other tradesperson employed by the client’s builder prior to fit off by Spy Vision (for buildings under construction). 1.4. The client recognises and acknowledges that Spy Vision’s quotation does not include the cost of locating cables not left visible in plaster (for buildings under construction) and this additional cost is borne by the client. 1.5. On completion of work, prior to hand over client needs to make sure either client or any authored representative of client will be available for any training, programming to mobile device or the main device including the positioning to their satisfaction. Failure to do and any additional visits are required for further training or setup will incur further charges.
ALARM INSTALLATION AND SERVICE CONDITIONS
2. It is the client’s sole responsibility 2.1. to provide, seven days’ notice of work required to be completed by Spy Vision 2.1.2. Provision of an accurate site plan 2.1.3. Confirmation of panels, Keypad, detectors, and siren location. Further, the client acknowledges that any repositioning requirements after installation is complete will incur further charges. Any holes or cut-out left open due to this need to be repaired by the client. 2.1.4. Provide 240V power points at the panel location 2.1.5. Data point and active Internet is required near main alarm panel, for Remote Arming/Disarming and for notifications through smart device if required. 2.2. The client acknowledges that it bears sole responsibility for: 2.2.1. Any damage caused to wiring after installation 2.2.2. All trenches to be made available prior to commence of work, unless otherwise specified in writing by Spy Vision. 2.3. The client recognises and acknowledges that all security wiring is left visible by the plaster, carpenter, tiler, or other tradesperson employed by the client’s builder prior to fit off by Spy Vision (for buildings under construction). 2.4. The client recognises and acknowledges that Spy Vision’s quotation does not include the cost of locating cables not left visible in plaster (in homes being built) and that this additional cost is borne by the client. 2.5. On completion of work, prior to hand over client needs to make sure either client or any authored representative of client will be available for any training, programming to mobile devices or delay period for sensors or panic buttons including adding users to their requirements. Failure to do and any additional visits are required for further training or setup will incur further charges.
3. INTERCOM SERVICE PROVISION
3.1. It is the client’s sole responsibility to provide: 3.1.1. Installation of wall boxes in brickwork, unless otherwise agreed to in writing by Spy Vision 3.1.2. Fitting of electrical door locking device, unless otherwise agreed to in writing by Spy Vision 3.1.3. Provide 240V power points at the panel location. 3.1.4. Connection of auxiliary equipment, where applicable. 3.2. The client acknowledges that it bears sole responsibility for all trenches, unless otherwise specified in writing by Spy Vision. 3.3. On completion of work, prior to hand over client needs to make sure either client or any authored representative of client will be available for any training, programming to mobile device or the main device to their satisfaction. Failure to do and any additional visits required for further training or setup will incur further charges.
4. DUCTED VACUUM SERVICE PROVISION
4.1. It is the client’s sole responsibility to provide: 4.1.1. Seven days’ notice of work required to be completed by Spy Vision 4.1.2. Provision of an accurate site plan 4.1.3. Confirmation of vacuum outlets and motor location. Further, the client acknowledges that any repositioning requirements after installation is complete will incur further charges 4.1.4. 240V power points. 4.2. The client acknowledges that it bears sole responsibility for: 4.2.1. Any damage caused to ducting or wiring after installation 4.2.2. All cutting of tiles, brick, or timber panelling, unless otherwise specified in writing by Spy Vision. 4.3. The client recognises and acknowledges that all outlet locations are left visible by the plaster, carpenter, tiler, or other tradesperson commissioned by Spy Vision. 4.4. The client recognizes and acknowledges that Spy Vision’s quotation does not include the cost of locating vacuum points not left visible in plaster and that this additional cost is borne by the client.
5. GENERAL INSTALLATION SERVICE CONDITIONS
5.1. The installation site must be clear and free from obstruction or obstacles. A site inspection will be carried out by a Spy Vision installer on the day of installation and Spy Vision accepts no liability for any delay in the installation schedule should the site be deemed dangerous or obstructed. 5.2. Where equipment requires installation, maintenance, or service over 2 meters high, an elevated work platform (EWP) will be required at the client’s expense. If an EWP is not detailed on Spy Vision’s quotation, Spy Vision will arrange EWP hire on the client’s behalf, at the client’s request and expense. 5.3 It is Client’s responsibility to advise Spy vision for any known issues related to the structure or any other parts of the building prior to commence of work. Spy Vision Cannot be held responsible for any minor damages occur due to building defects or fragile nature of the Roof/wall plaster/ceiling due to the age of the premises (commercial/Residential) while attempting to install any CCTV/Alarm/Intercom or Access control equipment. 5.4. Spy Vision reserves the right to alter equipment locations by up to 1 meter where it deems this a necessity to the construction integrity. 5.5. The client acknowledges and understands that problems arising from interference to intercom and security system by external electrical fields such as dimmers, electrical appliances, radio transmitters, SEC cables and other items are not covered by warranty.
6. QUOTATION
6.1. Unless otherwise stated in writing, Spy Vision’s quotation will be valid for a period of up to 30 days from date of issue, after which time Spy Vision may review the conditions of its offer or quotation at its discretion.
6.2. Site visit fees are included in Spy Vision’s location. The site visit fee includes two site visits, unless otherwise specified in writing within the quotation. Additional site visits will be charged per visit.
7. DEPOSIT
7.1. A non-refundable deposit of 30% is required to secure Spy Vision’s quote.
8. VARIATIONS
8.1. A Spy Vision quotation is made based on the information supplied by the client at the date of quotation issue. In the event of any variation, other than as directed or approved by Spy Vision, Spy Vision reserves the right to amend its quotation to reflect any and all additional costs involved in the variation of scope of works. Further, the client will be required to complete and sign a variation report fully detailing the variation.
9. PAYMENT TERMS
9.1. Spy Vision will invoice upon completion of each stage of the project unless prior arrangements have been made. All payment terms are strictly seven days from date of invoice. 9.2. Spy Vision reserves the right to recover from the client Customer all costs, expenses and charges incurred by Spy Vision in undertaking any debt recovery action, including legal fees on a full indemnity basis. 9.3. Cancellation of work allowed for residential customers, 24 Hrs prior to commence of work with no cost. Cancellation of work at the site with no legitimate reason will incur 10% of quoted value. No claims are recognised unless made within Seven days. 9.4. Title of goods sold by Spy Vision does not pass to the client until payment is received in full by Spy Vision. The client must hold insurance and fully indemnify Spy Vision in all aspects until title is passed.
10. LIMITATION OF LIABILITY
10.1. To the extent permitted by law, Spy Vision expressly denies all liability for any incidental, consequential, or indirect loss or damages of any kind that may occur prior to, at or after signing the Service Agreement. This includes liability based on contract, negligence, warranty, and any other theory of liability. 10.2. This exclusion specifically covers, but is not limited to, liability for: damages for loss of business, business interruption, loss of information, loss of goods, claims of third parties, loss of personal items arising out of: 10.2.1. performance or non-performance of the equipment; or 10.2.2. use or misuse of the equipment; or 10.2.3. provision of the services; or 10.2.4. power failures or surges; or 10.2.5. lightning; or 10.2.6. blown fuses; or 10.2.7. Patrol Response Service; or 10.2.8. any breach by the company of any of its obligations under this agreement. 10.3. This exclusion further covers the following types of damages: direct, indirect, special, incidental, consequential, and punitive. 10.4. This exclusion applies even where Spy Vision or its authorised representatives have been advised of the possibility of such damages or loss. 10.5. If Spy Vision is found liable for any loss or damage due to its negligence or failure to perform its obligations in this agreement, Spy Vision’s maximum liability will be limited to a sum not exceeding: 10.5.1. with regard to equipment, an amount equal to the purchase price of the equipment; or 10.5.2. with regards to the services, an amount not exceeding three (3) months of fees.
11. INDEMNIFICATION
11.1. The Client agrees to defend, indemnify, and hold harmless Spy Vision, its officers, directors, employees, members, agents and affiliates from and against any claims, actions or demands by any person or entity not party to this agreement except to the extent that: 11.1.1. such breach occurs while an employee or agent of Spy Vision is on the premises; and 11.1.2. such loss, damage, expense and liability are solely and directly caused by the said employee or agent.
